TERMS AND CONDITIONS
1. General
1.1 These terms and conditions apply to all offers, orders, and agreements of AudioSport Records, located at Leeuwarden.
1.2 By placing an order, you agree to these terms and conditions.
1.3 AudioSport Records reserves the right to change these terms and conditions. The modified terms and conditions will take effect upon publication on the website.
2. Offers and Agreements
2.1 All offers from AudioSport Records are non-binding and may be revoked at any time.
2.2 An agreement is established after acceptance of your order by AudioSport Records. AudioSport Records reserves the right to refuse orders or attach conditions to the delivery, unless explicitly stated otherwise.
3. Prices and Payment
3.1 The listed prices include VAT and exclude shipping costs, unless otherwise indicated.
3.2 Payment must be made using the payment methods offered by AudioSport Records. Products will be shipped after payment is received.
4. Delivery
4.1 AudioSport Records will exercise the utmost care in receiving and executing product orders.
4.2 Delivery time is usually 3-5 business days, unless otherwise agreed. Exceeding the delivery time does not entitle you to compensation.
4.3 Deliveries are made to the address provided by you. AudioSport Records is not responsible for delays caused by third parties.
5. Right of Withdrawal
5.1 You have the right to withdraw from the agreement within 14 days of receiving the products without giving any reason.
5.2 During the withdrawal period, you should handle the product and packaging with care. You may only unpack or use the product to the extent necessary to determine if you wish to keep it.
5.3 If you exercise your right of withdrawal, you must return the product with all delivered accessories and, if reasonably possible, in the original condition and packaging, following the reasonable and clear instructions provided by AudioSport Records.
6. Warranty and Complaints
6.1 AudioSport Records ensures that the products comply with the agreement, the specifications listed in the offer, the reasonable requirements of reliability and/or usability, and the existing legal provisions and/or government regulations on the date the agreement was established.
6.2 Complaints about the execution of the agreement must be submitted fully and clearly described to AudioSport Records within a reasonable time after you have discovered the defects.
6.3 Complaints submitted to AudioSport Records will be responded to within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, AudioSport Records will respond within the 14-day period with an acknowledgment of receipt and an indication of when you can expect a more detailed response.
7. Liability
7.1 Any liability of AudioSport Records and its employees and third parties engaged by AudioSport Records for damages arising from or related to the execution of the agreement is always limited to the amount paid by AudioSport Records' liability insurance in the relevant case. If the insurance does not provide coverage or does not pay out for any reason, liability is limited to the invoice amount.
7.2 AudioSport Records is not liable for damage resulting from improper use of the products.
8. Force Majeure
8.1 In the event of force majeure, AudioSport Records is not required to fulfill its obligations towards the customer. AudioSport Records is entitled to suspend its obligations for the duration of the force majeure.
8.2 Force majeure includes any circumstance independent of the will of AudioSport Records that prevents the fulfillment of its obligations towards the customer, including but not limited to internet or phone disruptions, transportation delays, strikes, government measures, as well as any other situation over which AudioSport Records has no (decisive) control.
9. Privacy
9.1 AudioSport Records respects the privacy of all users of its website and ensures that the personal information you provide is treated confidentially. Your data will only be used to process orders and will not be made available to third parties, unless they are involved in executing your order.
10. Governing Law and Disputes
10.1 All legal relationships to which AudioSport Records is a party are exclusively governed by Dutch law.
10.2 Disputes between AudioSport Records and the customer will be submitted exclusively to the competent court in the Netherlands.
